Terms and Conditions
Online Tutoring Services Agreement
The terms "Provider" or "us" or "we" refer to the owner of the Site, Amaze Services LLC and its services, DiligentTutors.com. The term "you" refers to the purchaser, student, parent and/or parent.
Purchasing an online tutoring package constitutes your acceptance of the terms contained in this Online Tutoring Services Agreement.
What we Provide.
We provide one-on-one and small group online tutoring sessions for K-12 students in English, Math and Science. We also provide one-on-one and small group sessions for Tagalog tutoring for English speakers of all ages.
Scheduling and Pricing.
Tutor bios are available for students and parents to browse on our Site. Students book tutoring sessions with our tutors through our Site. The prices of each tutor differ and can be viewed on our Site.
Payments.
Once you book your session or package with one of our tutors you will receive an online invoice which must be paid before the booking may be confirmed. Once payment is received then the student will receive a confirmation notice.
Obligations and Student Conduct.
All interactions with the tutor and among the other students should be conducted in a professional and respectful manner. Students are expected to be in a quiet and distractionfree environment for sessions. Use of profanities, explicit or offensive language and/or bullying is strictly prohibited and will subject the student to expulsion from the session at the sole discretion of the tutor. Students should ensure that their device, internet connection and necessary software are in proper working order prior to the start of the session. RECORDING THE TUTORING SESSIONS BY THE STUDENT/GUARDIAN IS STRICTLY PROHIBITED. WE DO NOT CONDONE ACADEMIC FRAUD, DISHONESTY OR MISCONDUCT.
Sessions.
Sessions should be scheduled in advance by the student with the tutor through the Site. It is the responsibility of the student to proactively coordinate and manage their prepurchased hours.
Release.
Group sessions may be recorded, at the discretion of the tutor. If recorded it will be stored for 2 weeks before being purged. By participating in the sessions, the student or parent, explicitly consents to same.
Punctuality.
Tutors and students are expected to log in on time for sessions. For one-on-one sessions, if the student anticipates being late and fails to notify their tutor, their assigned tutor is required to only wait on Google Meet for the first 15 minutes of the scheduled meeting. After that, the tutor will log off and unfortunately, the student will not receive a refund for the missed session.
Cancellation.
For one-on-one sessions, cancellations and rescheduling need to be made by the student at least 24 hours prior to the scheduled session date. For group sessions, student cancellations must be made at least 24 hours before the start of the first session. Once the session starts then no cancellations or rescheduling will be permitted. However, students who miss a group session will be given access to the recorded video, if available, of the missed session. If the tutor needs to reschedule a session due to an emergency, the student(s) will be notified as soon as possible and attempts will be made to reschedule the cancelled class at a mutually convenient time.
Refunds.
If cancellation was made 24 hours prior to the scheduled date on one-on-one session and/or 24 hours before the first session of the group class package, refunds can be given within 2 weeks after notice.
Non-Circumvention. You agree that you will not directly engage any tutors introduced to you through our platform without first notifying us and obtaining our consent. We cannot be held liable for any third party conduct.
Copyright.
Amaze Services LLC respects the intellectual property of you and the tutors. Users may not post, modify or reproduce content on the Site which is copyright protected. You must obtain prior written consent of the Copyright Owner to distribute content. We reserve the right to remove any content which infringes on third party rights.
Outcomes Disclaimer.
DiligentTutors.com and Amaze Services LLC make every effort to ensure that we accurately represent our tutors, their credentials and services. There is no guarantee of any particular outcome. As with any academic journey, your results may vary based on the student’s effort and level of desire. Before embarking in any tutoring experience, remember that success is based on many factors individual to each student such as educational background and academic skills.
Limitation of Liability.
Notwithstanding any damages that the student may incur, the entire liability of the Provider and its tutors and other affiliates will be limited to any amounts actually paid by you. In no event shall the Provider be liable for any special, incidental, indirect or consequential damages whatsoever, for personal injury, loss of privacy or any other type of loss.
Assumption of Risk.
You assume all risks when using this Site. Risks include association with any online or offline interactions with other Users. You should take precautions.
Indemnification.
You shall indemnify, defend and hold harmless Amaze Services LLC and all affiliates for any losses, expenses, claims, court costs and attorney’s fees incurred by us in any way related to your acts or omissions, violation of any rights, breach of these terms, disputes with other users, use and/or misuse of this Site and/or violation of any law or regulation.
Chargebacks.
You agree not to chargeback any payments made to us.
